A federal judge has ruled the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued confinement is without lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. After his return to the United States to face human smuggling charges, he was held in federal custody.

In her order, the court pointed out that the government does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."
